NATURE OF OUR SERVICES

NEXATOWER provides professional, customized digital development services, including video game creation, mobile applications, corporate gamification systems, graphic design, and tailored technological solutions.
Key characteristic: All our services are intangible and developed specifically according to each client’s individual needs, requiring an investment of time, specialized human resources, and technology from the moment any project begins.
Due to this personalized nature and the effort involved, refunds and returns are evaluated on a case-by-case basis in accordance with the principles set forth in this policy.

GENERAL REFUND PRINCIPLES

Commitment to Client Satisfaction
At NEXATOWER, we strive to meet our clients’ expectations through continuous communication, partial deliveries, and validations throughout the development process. Our goal is to ensure each project is successfully completed without the need for refunds.

Transparency and Good Faith
All refund decisions are made based on fairness, transparency, and good faith, seeking equitable solutions for both parties.

NON-REFUNDABLE SERVICES

The following items are not eligible for refunds:

Completed or Approved Services

  • Phases, modules, or deliverables already approved by the client.
  • Consultations, meetings, or advisory sessions already conducted.
  • Training sessions delivered or completed.

Project-Specific Expenses

  • Software licenses acquired exclusively for the project.
  • Third-party subscriptions contracted for development.
  • Third-party digital assets purchased (illustrations, music, 3D models, etc.).
  • App store publishing costs (Apple App Store, Google Play).
  • Fees for external specialists involved in the project.

Additional Services Already Rendered

  • Implemented optimizations or updates.
  • Completed integrations with external systems.
  • Approved designs, prototypes, or mockups.
  • Activated hosting, domain, or infrastructure services.

Causes Beyond NEXATOWER’s Control

  • Change of mind after prior approvals.
  • Modification of the client’s business or commercial strategy.
  • Loss of interest or change in priorities not attributable to NEXATOWER.

REFUND REQUEST PROCESS

  1. Request Submission:
    Send an email to [PENDING] with the subject “Refund Request,” including contact details, purchase reference, and detailed reasons.
  2. Acknowledgment:
    NEXATOWER will confirm receipt of the request within a maximum of 3 business days.
  3. Evaluation:
    Our team will review the project status, communication history, and applicable policy conditions.
  • Review time: up to 10 business days for simple projects, and up to 20 business days for complex projects.
  1. Resolution:
    NEXATOWER will notify the final decision, indicating whether the refund is approved, the applicable amount (if any), and the method of reimbursement.

REFUND METHODS AND TIME FRAMES

  1. Refund Method:
    All approved refunds will be processed exclusively to the same bank card used for the purchase.
  2. Processing Time:
    Once authorized by NEXATOWER, the refund will be processed immediately. However, the time it takes to reflect in the client’s account depends directly on the issuing bank’s policies and timelines, which may range from 15 to 30 business days.

Consumers retain the right to file complaints with the Federal Consumer Protection Agency (PROFECO) and to use available conciliation mechanisms.

CHANGES TO THIS POLICY

Any modifications will be published on our website with the corresponding update date.
Changes will not affect refund requests already in process.
